Ninth District Judge Hears Supreme Court Case

Judge Clair E. DickinsonJudge Clair E. Dickinson of the Ninth District Court of Appeals served as visiting judge on the Supreme Court of Ohio today and heard oral arguments in one case.

Judge Dickinson was selected by Chief Justice Thomas J. Moyer to sit in place of Justice Robert R. Cupp, who recused himself from State v. Joseph (Case Nos. 2008-0711 and 2008-1005).

According to the Ohio Constitution, in the event of a recusal by a Justice, the Chief Justice of the Supreme Court can select any of the 68 sitting Ohio appellate court judges to sit temporarily on the Supreme Court.

“We are pleased to have Judge Dickinson join us today,” Chief Justice Moyer said. “His participation provides the parties in the case with a court of seven justices despite the recusal of Justice Cupp.”

The Joseph case – out of Allen County – involves whether a trial court can impose court costs in a defendant’s sentencing entry when the court fails to address the issue during a defendant’s sentencing hearing.

After serving one term on the appeals court from 1993 to 1999, Judge Dickinson returned for his second stint as an appellate judge in February 2007. Interspersed with his time on the bench, Judge Dickinson twice served as a member of Summit County Council and as president of the body three separate years. His experience in private practice includes work as an associate for Jones, Day, Reavis & Pogue and as a member and chair of the litigation group and head of the appellate practice group for Brouse McDowell. Judge Dickinson received his law degree from the Cleveland-Marshall College of Law.

“It is a great honor and privilege to be selected by the Chief Justice to serve the court,” said Judge Dickinson.

The Ninth District Court of Appeals serves Lorain, Medina, Summit and Wayne counties, and hears cases from county, municipal and common pleas courts as well as original actions in habeas corpus, mandamus, prohibition, procedendo and quo warranto.
