Supreme Court Guide Helps Self-Represented Litigants
Ohioans who represent themselves in cases before the Supreme Court of Ohio can turn for guidance to a publication released today.
“A pro se Guide” for filing an appeal in the Supreme Court contains information on filing deadlines and filing fees, examples of what properly filed documents look like, summaries of the Rules of Practice, and a glossary of legal terms and definitions. The guide also covers topics such as the hours of operation for the Clerk’s Office, frequently asked questions about the appeals process, and an overview of Ohio’s judicial system.
A person appearing pro se is proceeding without the assistance of a licensed attorney. The Supreme Court has seen a marked increase in the number of appeals filed by self-represented litigants in the past year, which climbed to more than 40 percent for the first time in recent years, said Supreme Court Clerk Kristina D. Frost.
“Because of the recent rise in pro se cases, it made sense to produce a guide that would help Ohioans navigate the process of filing an appeal in the Supreme Court,” she said. “While the Clerk’s Office cannot provide legal advice, staff members regularly explain how to appeal a case and provide information about the Supreme Court Rules of Practice. This guide simply presents that information in written form.”
Additional guidance for self-represented litigants was one of the recommendations contained in the 2006 report by a Supreme Court Task Force on Pro Se and Indigent Litigants. “Pro se litigants present a tremendous challenge for Ohio’s courts,” the report concluded. “Pro se litigants, whether voluntarily unrepresented or unable to afford counsel, must be able to participate in a meaningful way in our justice system. We believe that the use of standardized forms and procedures, enhanced guidance and support for pro se litigants, and wide, convenient availability of information are important steps in achieving this goal.”
In addition to making the guide available through the Court’s Web site, plans for distribution include providing copies to all of Ohio’s correctional institutions, and upon request to anyone considering filing an appeal with the Ohio Supreme Court.
