Supreme Court Seeks Public Comment on New Juvenile Protection Order Rule, Forms

The Supreme Court of Ohio will accept public comment until July 20 on a new rule that would authorize juvenile courts to issue civil protection orders against juveniles and standardized forms with instructions about how to petition the court for a protection order. Justices concurred 7-0 in publishing the rule and forms for public comment.

After the General Assembly revised the law about civil protection orders and enforcement, the Supreme Court Advisory Committee on Domestic Violence Forms Subcommittee recommended the forms and adoption of new Rule 10.05 of the Rules of Superintendence for the Courts of Ohio.

The juvenile civil protection forms were proposed in response to Am Sub HB 10, which authorizes juvenile courts to issue and enforce civil protection orders where the respondent is a minor, regardless of the familial relationship between the parties. The new law went into effect on June 17.

The forms, which would be issued by all juvenile courts in Ohio, will be available on the Supreme Court’s Web site.
