Supreme Court Suspends Lakewood Attorney

2008-1768.  Disciplinary Counsel v. Jarabek, Slip Opinion No. 2009-Ohio-748.
On Certified Report by the Board of Commissioners on Grievances and Discipline, No. 07-050.  Timothy J. Jarabek, Attorney Registration No. 0069298, is suspended from the practice of law in Ohio for two years, with one year stayed on conditions, with no credit for time served under respondent’s interim suspension.
Moyer, C.J., and Pfeifer, Lundberg Stratton, O'Connor, O'Donnell, Lanzinger, and Cupp, JJ., concur.

(Feb. 25, 2009) The Supreme Court of Ohio has suspended the law license of Lakewood attorney Timothy J. Jarabek for two years with the second year of that term stayed on conditions. Jarabek’s license has been under an interim suspension since October 2006, when the Court was notified that he had been convicted on a felony count of drug possession.

In today’s decision, the Court adopted findings by the Board of Commissioners on Grievances & Discipline that, in addition to the misconduct represented by his criminal possession of illegal drugs, Jarabek also had neglected an entrusted legal matter by failing to appear at a client’s court appearance and had practiced law while his license was under suspension by preparing and filing a motion and notice of appearance in a court proceeding and signing the name of another attorney on those documents.

The Court specified that the partially stayed suspension imposed today is not retroactive to the date of Jarabek’s interim suspension. Under the terms of today’s judgment, if all other conditions of the stay are met , Jarabek would be eligible to apply for reinstatement  Feb. 25, 2010.
