2012-0019. Wilson v. Kasich, Slip Opinion No. 2012-Ohio-612.
This cause originated in this court upon the filing of a complaint invoking this court's original jurisdiction pursuant to the Ohio Constitution, Article XI, Section 13.
Consistent with the opinion rendered herein, it is ordered by the court that relators’ open-meetings claim is dismissed for lack of subject-matter jurisdiction. It is further ordered that relators’ Article XI claims challenging the use of the apportionment plan for the 2012 election cycle are barred by laches and therefore dismissed. Relators’ remaining Article XI claims are not barred by laches, and the court will order further briefing and schedule oral argument on those claims.
O’Connor, C.J., and Pfeifer, Willamowski, Lanzinger, Cupp, and McGee Brown, JJ., concur.
O’Donnell, J., concurs in part and dissents in part.
John R. Willamowski, J., of the Third Appellate District, sitting for Lundberg Stratton, J.
